What a UK Employer of Record Actually Does
An EOR becomes the legal employer of your UK hire on paper. It issues the employment contract, registers the employee for PAYE, files Real Time Information submissions to HMRC every pay period, pays employer National Insurance, enrols them into a qualifying pension scheme under The Pensions Regulator’s auto-enrolment duties, and administers statutory leave and sick pay.
You direct the work. They carry the employment relationship. That split is the entire product, and everything else on a vendor’s feature list is packaging around it.
It does not give you a UK presence for anything else. No UK bank account, no VAT registration, no ability to sign commercial contracts in your own name. If you need those, you need a UK entity, and an EOR is a bridge to that rather than a substitute for it.
It does not fully remove permanent establishment risk. If your UK employee habitually negotiates or concludes contracts on your behalf, HMRC may treat that as a taxable presence regardless of who employs them on paper.
A London sales hire carries meaningfully more exposure here than a London engineer. Raise it with your tax adviser before the first commercial hire, not after.
It does end your IR35 problem, but only by changing the relationship. IR35 and the off-payroll working rules govern contractors, and employment status is what determines which regime applies. An EOR employee sits inside employment with PAYE deducted at source, so the rules stop applying.
Converting a long-running UK contractor to EOR employment closes that exposure, and RemoFirst, Remote.com and Oyster HR all handle the conversion inside the same platform.
It does not make you immune to employment claims. Discrimination, health and safety duties and whistleblowing protections can still reach the end client depending on how the working relationship actually operates. The EOR carries the contract. It does not carry your management decisions.

Employer of Record vs Employment Business: Which Licence Applies
The UK has no dedicated EOR licence and no EOR-specific regulator. What it does have is a different, heavily regulated activity that gets confused with EOR constantly, and the distinction decides whether any authorisation is needed at all.

Ask which model applies and which entity sits on the employment contract. A direct contract with the provider’s own UK entity means you are in the EOR model and no licensing question arises.
There is a fifth option that is not an EOR at all. If most of your team is already British, a UK entity plus payroll software costs less than any provider here at scale. EOR earns its price when entity setup is the thing you are avoiding, and stops making sense somewhere between 15 and 25 UK employees depending on salary levels.
What UK Law Actually Costs You
Employer NIC and pension
Employer National Insurance is 15% on everything above the £5,000 secondary threshold, with no upper limit. Both figures are frozen until 2030/31.
On a £60,000 salary that is £8,250 a year. Class 1A on benefits in kind is charged at the same 15%.
Auto-enrolment adds a minimum 3% employer contribution for anyone earning over £10,000, calculated on qualifying earnings of £6,240 to £50,270. Roughly £1,300 a year on a £50,000 salary.
Employment Allowance is £10,500 for 2026/27, but it is claimed by the legal employer, which is your EOR rather than you. Ask whether it gets passed through.
A £60,000 UK hire costs around £69,500 before the platform fee. The spread between providers on this page is a rounding error against that.
PAYE and the Scottish gap
Your provider runs PAYE and files RTI to HMRC every payday. Personal allowance is £12,570, higher rate starts at £50,270, additional rate at £125,140.
Scotland runs six income tax bands from 19% to 48%, against three elsewhere in the UK. An Edinburgh hire nets less than a Manchester hire on identical gross pay, which matters if you benchmarked the offer on take-home. Confirm your provider handles Scottish taxpayer status correctly.
IR35
Off-payroll working rules put status determination on the end client for medium and large companies. Get it wrong and you inherit the unpaid PAYE and NIC.
EOR employment removes the problem entirely, since tax is deducted at source. It is not retrospective cover, so historic exposure needs separate advice.
RemoFirst, Remote.com, Oyster HR and Rivermate all convert contractors in-platform. Oyster backs the transition to $500,000 through Oyster Shell.
Right to work
A correct right to work check before the start date gives you a complete statutory defence. Failing to gives you up to £45,000 per worker for a first breach and £60,000 for a repeat within three years.
From 1 October 2026, a revised Code of Practice extends these duties to labour supply chains, subcontractors and some online platforms. If you engage UK workers outside direct employment, that is worth reviewing now.
For sponsorship, Pebl runs immigration in-house with Vialto Partners. Globalization Partners, Oyster and Remote all support permits. Rippling and Rivermate do not.
Notice and redundancy
Statutory notice is one week between one month and two years service, then one week per year, capped at 12 weeks.
Statutory redundancy needs two years service. From 6 April 2026 the weekly pay cap is £751 and the maximum payment is £22,530.
The cap is what surprises people. Someone earning £1,500 a week is still calculated at £751, so statutory redundancy costs far less than most buyers expect.
First £30,000 is tax free. Payment in lieu of notice is always taxable under the PENP rules.
Penalty exposure
Right to work is the big one at £45,000 to £60,000 per worker. Late RTI filing, auto-enrolment failures and tribunal awards sit behind it, and discrimination awards are uncapped.
Your EOR carries these as legal employer. It does not carry your management decisions, so a claim arising from how you managed someone can still reach you.
Same two verification notes stand: one source quoted a £700 redundancy cap and another a £12,750 personal allowance. Both conflict with GOV.UK, so I used £751 and £12,570.
UK Visa Sponsorship for EOR Employees: Which Routes Need a Licence
Sponsorship is the single biggest hard blocker on this page, and it decides the shortlist before price or platform ever come into it. A sponsor licence is held by the employing entity, so if you hire through an EOR, the EOR needs the licence, not you. Not every provider has one. For future engagements, yes. IR35 applies where someone works through an intermediary such as their own limited company. An EOR employee sits inside employment with PAYE deducted at source, so the rules stop applying entirely.
It is not retrospective cover. Converting a contractor today does nothing about exposure from previous tax years, and HMRC can look back. Handle the historic position separately.

The EOR does, as legal employer. A correct check before the start date creates a statutory excuse, which is a complete defence against penalty.
